How Are Severance and Notice Pay Calculated, and When Are They Owed?

Severance pay and notice pay are two different payments an employee may be entitled to when an employment contract in Turkey ends, and they're frequently confused with one another. Severance pay is paid at a rate of 30 days' gross wage for each full year the employee spent with the same employer (up to the severance ceiling), and entitlement to it only arises for certain types of termination. Notice pay, on the other hand, is compensation paid by whichever party terminates the contract without observing the notice period, ranging from 2 to 8 weeks depending on seniority; it's calculated independently of severance pay and has no minimum service requirement.

When to use it: to estimate in advance how much compensation you'll receive — or how much your employer owes — before a dismissal or resignation, to see the value of your current seniority when evaluating a new job offer, or to budget the cost of termination as an employer. Entitlement to severance pay arises from termination by the employer without just/valid cause, justified termination by the employee (e.g. unpaid wages), military service, retirement, and a female employee leaving within one year of her marriage date; as a rule, an employee who resigns voluntarily without showing just cause cannot receive severance pay.
